Em 3 de dezembro de 2024, durante a audiência pública “Impactos da Reforma Trabalhista” na Câmara dos Deputados, o Ministério Público do Trabalho (MPT) destacou a necessidade de estabelecer limites claros para a terceirização no Brasil. O procurador Renan Bernardi Kalil, coordenador nacional de Combate às Fraudes nas Relações de Trabalho do MPT, enfatizou que, embora haja uma percepção de que a terceirização é amplamente permitida, a legislação impõe três requisitos essenciais para sua legalidade:
Transferência da execução da atividade: a responsabilidade pela execução deve ser da empresa contratada, não de um trabalhador específico.
Autonomia na execução do serviço: a empresa prestadora deve ter independência na realização dos serviços.
Capacidade econômica compatível: a contratada deve possuir recursos adequados para cumprir o contrato, incluindo o pagamento dos direitos trabalhistas aos empregados envolvidos.
Kalil alertou para o aumento da “pejotização” após a Reforma Trabalhista, prática que o MPT considera fraudulenta, pois transforma trabalhadores subordinados em supostos sócios ou titulares de pessoas jurídicas, mascarando vínculos empregatícios reais. Essa prática resulta em precarização das condições de trabalho e impactos fiscais negativos para o erário público.
O procurador Tiago Ranieri, representando a Associação Nacional das Procuradoras e dos Procuradores do Trabalho (ANPT), reforçou que a Reforma Trabalhista não cumpriu suas promessas de modernização das relações de trabalho, geração de empregos e aumento da produtividade. Ao contrário, observou-se maior precarização, aumento da informalidade, redução salarial, enfraquecimento sindical e ampliação da desigualdade. Ranieri também criticou a “pejotização”, afirmando que, quando presentes os requisitos de uma relação de emprego, deve-se estabelecer um contrato de trabalho formal.
Os participantes da audiência analisaram os efeitos da reforma no mercado de trabalho, na qualidade do emprego, na dinâmica processual trabalhista, no desenvolvimento econômico do país e na organização sindical, destacando a importância de regulamentar adequadamente a terceirização para proteger os direitos dos trabalhadores e garantir condições laborais dignas.
